Compulsory or forced retirement is a dismissal and retirement is no longer a fair reason for dismissal. Employers can still set a contractual retirement age and insist on retirement on reaching that age but only where this can be objectively justified. If it cannot be justified, dismissal for this reason will amount to age discrimination (see page 240).
