TUPE and pensions
[ch 6: page 67]TUPE contains an important exclusion relating to pensions. Regulation 10 excludes any provisions relating to “old age, invalidity or survivors’ benefits under an occupational pension scheme”. Pension rights that have already accrued in the scheme operated by the outgoing employer are protected, but occupational pension obligations do not transfer to the new employer.
