The case of Gonzáles Castro v Mutua Umivale [2018] IRLR 1142 involved a security guard who worked rotating shifts, some at night. The ECJ ruled that pregnant workers and those who have recently given birth or are breastfeeding and work shifts, some of which are at night, must be regarded as performing night work and therefore enjoy specific protection against the risks that night work is liable to pose.
