In Barclays Bank plc v various claimants [2020] UKSC 13, the Supreme Court allowed an appeal by the bank and held it was not vicariously liable for sexual assaults committed by an independent doctor who was carrying out medical examinations on its behalf. Reversing a previous ruling, Lady Hale set out that the doctor was not at any time an employee or anything close to an employee of Barclays, but rather in business on his own account as a medical practitioner.
