The tribunal also found that there was a health and safety rep with whom Miles could have raised his concerns, even though he was not aware of the rep because they were not based in Pontefract. The tribunal rejected his argument that the safety rep did not count for the purposes of section 44 because he was not based in his workplace. The EAT agreed it was sufficient for the rep or committee to cover the workplace (see page 49).
