If it might have been reasonably practicable to have raised the concerns via a rep, and the employee did not do so, they must show there were “circumstances of danger of which the employee reasonably believed to be serious and imminent” (Miles v Driver & Vehicle Standards Agency [2023] EAT 62) (see page 52).
