Health and Safety Law 2024 (October 2024)
The BALPA pilots’ union won the leading ECJ holiday pay ruling, Williams v British Airways [2011] EUECJ C-155/10. This ruling established that a worker must be paid their normal remuneration when taking statutory holiday under the WTD. In other words, pay while on holiday must be the same as normal pay when working. Any other interpretation would defeat the Directive’s health and safety purpose, because workers would be deterred from taking holiday through fear of income loss.
