Unions have fought and won various key rulings about holiday pay in the European and national courts. ECJ rulings about holidays and holiday pay only apply to the four weeks of holiday under the WTD, not the extra 1.6 weeks under UK law or any extra contractual holiday pay. Employment tribunals and the Employment Appeal Tribunal (EAT) remained bound by these pre-transition period rulings but, as Chapter 1 sets out, the Court of Appeal and Supreme Court are free to decide not to follow them. The EU Law (Revocation and Reform) Act 2023 contains provisions to make further changes to the way courts interpret EU law, although these had not been enacted before prime minister Rishi Sunak called a general election in May 2024.
