Health and Safety Law 2024 (October 2024)

An employment tribunal found that the principal reason for her dismissal was her complaint about working time but dismissed her claim on the grounds that the complaint must be about a breach of a statutory right which has already taken place. However, the EAT said it was the instruction to work the hours which infringed her working time rights. Her appeal was allowed, and she won her claim for automatic unfair dismissal.
