However, by day two, the weather had started to improve. The workers lost their claim for automatically unfair dismissal. The tribunal accepted that there was a serious and imminent threat to their health or safety when they walked off site on day one. However, once the weather improved, the hazard was no longer “imminent”, so their claim under section 44, ERA 1996 was dismissed.
