The wording is the same in relation to detriment, except that, following a judicial review case against the government, won by the IWGB union, the protection applies not just to employees (as in the past) but to the wider category of workers. This change was introduced by the Employment Rights Act 1996 (Protection from Detriment in Health and Safety Cases) (Amendment) Order 2021.
