It was enough to show that the rep’s union activities influenced his decision to dismiss. The case also shows that the motivation of any manager who intervenes in the disciplinary process, whether formally or informally, can be taken into account when deciding whether a dismissal was for trade union reasons, even if they do not take the final decision to dismiss.
