Health and Safety Law 2024 (October 2024)

Article 18 requires the responsible person to appoint competent people to help implement the preventive and protective measures. A competent person is defined as someone who “has sufficient training and experience or knowledge and other qualities to enable [them] properly to assist in undertaking the preventive and protective measures”. The competent person must be given adequate means and “the time available for them to fulfil their functions”. The responsible person must appoint a competent employee in preference to an outside person, such as a contractor.
