Health and Safety Law 2024 (October 2024)

Section 37 of the HSWA deals with offences committed by an employing organisation with the “consent or connivance” of, or due to any “neglect”, on the part of any director, manager, secretary or other similar officer, or anyone claiming to have this kind of authority. That person can be found guilty of the offence, alongside the employing organisation (see for example Armour v Skeen on page 4).
