• Section 33 sets out the offences and penalties under the HSWA. Fines are unlimited and prison sentences of up to six months (if the case is heard in the magistrates’ courts) or two years (if the case is heard in the Crown Court) can be handed down for most health and safety offences. Longer prison sentences can be handed down where an individual is found guilty of gross negligence manslaughter (see Chapter 2: Enforcement);
