In February 2022, Mr Smith, a heating engineer, won a long-running holiday pay claim against his former employer in Smith v Pimlico Plumbers Limited [2022] EWCA Civ 70. In general, EU-derived law tests whether someone is a worker by looking at the extent to which they are integrated into and controlled by the organisation, such as an app provider, to which they are providing their services. The greater the evidence of integration and legal control, the more likely the person is to be a worker, with worker rights.
