The Supreme Court rejected the argument that this provision does not apply to sleep-in workers because they are already “working” throughout their shift. Instead, such workers are entitled to receive a shift payment, topped up by any hours that they are actually called upon to work. This was the recommendation of the Low Pay Commission (LPC) when the NMWA was introduced, and the Supreme Court took that into account.
