Until 2021, a series of cases had established that workers who were required to stay on the premises to deal with emergencies may be classed as working throughout their sleep-in shift even if they did not have to get up to do anything, and they were entitled to the National Minimum Wage (NMW) for all of these hours. This was because simply having to be at the premises and ready to respond was “work” in itself.
