Having to be physically present at the place determined by the employer, and to remain available for work, is a “decisive factor”. An interpretation of “working time” that does not include periods of vocational training required by the employer would allow them to impose training obligations outside of normal working hours, to the detriment of the worker’s right to sufficient rest, the court added.
