Unite won a similar case, Bailes v First Bristol Ltd, in 2015. Mr Bailes, also a bus driver, lost his job of 22 years after a saliva test came back positive for a class A drug. The tribunal found the positive test was likely to be the result of handling contaminated bank notes and awarded him damages of nearly £84,000.
