In Brazier v Dolphin Fairway Ltd [2005] All ER (D) 76 (Nov) a machine operator lost a claim for personal injury after developing a hernia he alleged was the result of lifting pallets from a stack. He did not call expert evidence, provide site photographs, or show the condition the pallets were in, and did not provide sufficient evidence to prove a foreseeable risk of injury.
