Disputes over SSP

There can be problems and disputes over the payment of SSP. Some employers refuse to accept self-certification and Fit Notes as confirmation of an inability to work. Some staff may simply find themselves being “taken off the rota” when they are sick, rather than being paid the SSP they are entitled to.

If an employer decides an employee is not entitled to SSP it must give the reasons in writing. If it does not believe the employee is sick (even with evidence from their doctor) the employee may need to go for an independent medical examination, arranged (with their permission) through HMRC. An appeal against non-payment can be made to HMRC within six months of the refusal to pay.
