If an employer refuses to voluntarily recognise a trade union for collective bargaining, the union can go through the statutory recognition procedure under the Trade Union and Labour Relations (Consolidation) Act 1992(TULRCA).

TULRCA also contains provisions to protect union members from unfavourable treatment because of their union membership and/or activities.
