Health and Safety Law 2021 (October 2021)

Chapter 2

Key changes and developments

[ch 2: page 37]

• In a GMB general union-backed case, the Supreme Court has ruled that Uber drivers are not self-employed, but that workers are entitled to rights including holiday pay, a guaranteed minimum wage, and an entitlement to breaks;

• New regulations confirmed the small claims limit for workplace injury claims will remain at £1,000 — a victory for union campaigning;

• There are some immediate changes to health and safety regulation as a result of the UK’s exit from the EU, and fears that the post-Brexit deal, the UK-EU Trade and Cooperation Agreement (TCA), will allow the Tory government to weaken health and safety rights and protections;

• The IWGB union won a judicial review case in the High Court confirming the government failed to grant workers health and safety protections they are entitled to under EU laws.
