Two types of claim can be brought by an employee who has made a protected disclosure under PIDA: automatically unfair dismissal and detriment. A worker can claim only whistleblowing detriment.

The time limits are different for each claim so early legal advice should be taken. As always, tribunal deadlines are very short.

Claims for whistleblowing detriment can be brought against the employer, agents of the employer acting with the employer’s authority and co-workers in the course of their employment.
