Workers outside Great Britain
[ch 7: page 231]For workers based outside Great Britain, whether a claimant can enforce rights under the EA 10 depends on the strength of connection with Great Britain (Hottak v Secretary of State for Foreign and Commonwealth Affairs & Anor [2016] EWCA Civ 438). This is the same as the test used for claims of unfair dismissal (See Chapter 10).
Special regulations, the Equality Act 2010 (Work on Ships and Hovercraft) Regulations 2011, extend protection from discrimination, harassment and victimisation to those working at sea.
