Chapter 1

What conduct is prohibited by the EA 10?

Broadly, the EA 10 provides protection at work from the following categories of behaviour, each of which has a precise legal meaning:

• direct discrimination (associative and perceived) (see Chapter 4);

• indirect discrimination (see Chapter 7);

• harassment (associative and perceived) (see Chapter 5); and

• victimisation (associative and perceived) (see Chapter 6).

Disabled workers have two extra specific categories of protection, that are unique to them. These are:

• the right to reasonable adjustments at work (section 20, EA 10); and

• the right not to be treated unfavourably for a reason arising from their disability (section 15, EA 10).

These two rights are explained in Chapter 8.
