Tribunal claims

If an employer is unwilling to negotiate, the one consequence they will want to avoid is a series of expensive and potentially embarrassing tribunal claims. Human resources staff are often appraised on how many claims are brought against the employer and such an outcome doesn't reflect beneficially on them. Accordingly, while it may well be unhelpful to issue empty threats of legal action, equally it is probably better not to indicate that it is a course of action that you would definitely prefer to avoid.
