Using information and consultation rights - a union rep's guide (November 2016)

Chapter 12

12. Other information and consultation rights

[ch 12: page 62]

The ICE regulations are not the only legally enforceable information and consultation rights available, although they are the most general. Like the ICE regulations, some of these other rights stem from European Union directives but are now part of the UK legal system. Some depend on union recognition. Most can operate alongside an ICE arrangement (where there is one) but in some cases (redundancies, business transfers and pension changes) there is a regulatory overlap.

The aim of this chapter is not to explain these other rights in full (see LRD publications the Law at Work and Health and Safety Law) but to indicate how they contribute to information and consultation at work. The chapter covers:

• consultation on collective redundancies;

• consultation on business transfers (TUPE);

• consultation on pension scheme changes;

• information for collective bargaining purposes;

• health and safety consultation;

• European Works Councils; and

• other European information and consultation rights.
