Complaints about the operation of the regulations can be made at many points in the proceedings, as previous chapters have shown. That can be done from the very first application for data (under regulation 6, see page 19) right through to the employer’s compliance with commitments to inform and consult (regulation 22) and rules on disclosure and confidentiality (regulations 25 and 26).

Enforcement powers generally lie with the CAC, but different arrangements apply to complaints about rights to paid time off, any detriment suffered by reps or employees under the regulations, or any unfair dismissals. These have to be dealt with through the employment tribunal system. A breach of confidentiality (see page 50) could be pursued in the civil courts.
