Asking questions about unequal pay

Women who suspect that they are suffering pay discrimination can ask their employer structured questions about their pay by following Acas guidance: Asking and responding to questions of discrimination in the workplace. Tribunals can take evasive or incomplete answers about pay into account when deciding whether an employer has broken equal pay law.

Under section 77, EA 10, contract terms that prevent workers discussing their pay to work out whether there is pay discrimination at their workplace are unlawful. On the other hand, employees do not have to discuss their pay if they do not want to.
