Health and safety law 2019 (July 2019)

Chapter 9

Recording working time

[ch 9: page 167]

A recent European Court of Justice (ECJ) case brought by a Spanish trade union, Federación de Servicios de Comisiones Obreras (CCOO) v Deutsche Bank SAE [2019], held that employers must keep records of actual hours worked in order to comply with the Working Time Directive. This is not currently a requirement under the Working Time Regulations 1998 and the government should amend the regulations to properly transpose the Directive into UK law.
