Enforcement of contractual rights
[ch 1: page 8]Claims for contract breach can be brought in the ET or the civil courts. However, ET claims for contract breach can only be brought if employees are no longer employed by their employer.
Anyone who still works for their employer must bring a contract claim in the civil courts or a statutory claim for unlawful deduction of wages in the ET (see below).
The deadline for an ET claim is very short — in most cases just three months less one day from the date of the contract breach. By contrast, the time limit for claims for contract breach in the civil courts is six years.
