• Holding a ballot for endorsement of an employee request (regulation 8): The employer must inform employees within one month of the employee request and ballot as soon as is reasonably practicable but not before 21 days have passed since employees were informed

• Challenge to the employer’s failure to inform employees about the ballot (regulation 8(7)) or carry out a ballot (regulation 8(8))

• Pre-existing agreements in a group of companies (regulation 9)

• Challenge to an employer’s entitlement to hold a ballot (regulation 10(1)) – within 21 days of the employer informing employees of the intention to hold a ballot

• Challenge to ballot arrangements (regulation 10(2)) within 21 days of the date of the ballot

Restriction (“three-year moratorium”) on employee requests/employer notifications (regulation 12)
