Disciplinary and grievance procedures - a guide for union reps (June 2018)

Chapter 8

Facilities under the Acas Code on time off for trade union duties

[ch 8: page 61]

The Acas Code on time off gives guidance on appropriate facilities for reps needing to confer privately with members involved in formal procedures. Facilities should include access to a telephone, computer, email, photocopier or printer and to a private room where the worker can discuss the issues confidentially. The right is to time off from normal work duties. It is not a right to work from home, although it may be possible to negotiate some homeworking to prepare for representation duties where there is no private quiet space in the workplace.

Where surveillance evidence (for example, CCTV footage or tape recordings) is involved, the rep and member should be given facilities to watch/listen at least once in private.
