Outcome of a final hearing at the tribunal

If a disability discrimination claim is successful, the tribunal has the power to order an employer do one or more of the following:

• pay compensation;

• pay the worker’s tribunal fees;

• make a recommendation within a specified time for the employer to take action to reduce, partly or completely, the negative effects on the worker;

• order reinstatement or re-engagement of the worker.

Reinstatement or re-engagement may not be practical and the tribunal cannot force the parties to carry this out. However, if an employer unreasonably refuses either of these tribunal decisions then they may face an additional (financial) award against them.
