Extending time to bring a discrimination claim

[ch 18: page 128]

An employment tribunal has discretion to extend the time limit for a discrimination claim if it is “just and equitable” to do so. Extensions of time are hard to achieve. Tribunals expect a very good reason for the delay, supported by credible, specific evidence, and fast action to issue the claim once the deadline has passed.

No time extension is ever possible in a tribunal claim for equal pay.
