Past disability

The EA 10 continues to protect someone who was disabled in the past and has since recovered (section 6(4), EA 10). For example, someone who suffered from a mental illness in the past that has not recurred will continue to be protected from less favourable treatment by an employer due to their past disability (for example, not being promoted because the employer is concerned that an old illness could resurface).
