Redundancy law - a guide for union reps (November 2019)

Chapter 8

Claiming unpaid redundancy pay

[ch 8: page 68]

An employee can bring a claim in an employment tribunal if their employer has not paid their redundancy pay. The time limit for claiming statutory redundancy pay is six months from the date of dismissal. However, if the employee also has an unfair dismissal claim, this must be brought within three months (less one day) of the date of termination.

The deadline for claiming contractual redundancy pay is three months (less one day) from the date of dismissal.
