Information on proposed redundancies
[ch 3: pages 37-38]Under section188(4) TULR(C)A 1992, the employer must provide the employees’ representatives (whether trade union officials or elected employees) with the following information:
• the reasons for the redundancies;
• the numbers and description of employees whom it proposes to make redundant;
• the total number of employees of any description;
• the selection procedure to be used (the criteria should be as objective as possible — e.g. timekeeping rather than “attitude”, to prevent managers disposing of people for subjective reasons);
• the proposal for how the redundancy dismissals are to be carried out, including the timescale; and
• the proposed method of calculating the amount of any redundancy pay, if this is more than the statutory minimum.
