Detriment

In a claim for whistleblowing detriment, the tribunal can make a declaration and award “just and equitable” compensation. An award for injury to feelings can be made in a claim for whistleblowing detriment but not dismissal.

Where the whistleblower is an employee, depending on the facts of the claim it is possible to claim for both whistleblowing detriment and automatically unfair dismissal (see page 35).
