Sickness absence and sick pay - a guide for trade unions and working people (December 2018)

Chapter 5

Casual, zero hours and agency workers

[ch 5: page 88]

For casual (or short/zero hours contracts) and agency workers who meet the qualifying conditions, the period for which SSP is due is different depending on whether the employee has had three months’ continuous employment with the employer or not:

• where the employee has had at least three months’ continuous employment, SSP entitlement will continue for the whole of the PIW unless they have been given written notice that the contract has come to an end or SSP entitlement stops for some other reason;

• where the employee has not had three months’ continuous employment, SSP entitlement will continue to the end of any assignment they had agreed to work (the employee may have been offered and accepted other assignments when they went sick, in which case entitlement will continue until the end of the last accepted assignment and the periods in between, unless the contract has been ended in writing).
