Health and Safety Law 2020 (August 2020)

Chapter 5

Compensation

[ch 5: page 95]

The maximum compensatory award for unfair dismissal is capped at £88,519 (from 6 April 2020), or 52 weeks’ gross pay, whichever is the lower. However, there is no maximum cap in cases of dismissal for health and safety reasons or for whistleblowing. In practice, however, large awards are rare. Last year (2018-19), the average and median awards for successful unfair dismissal claims were £13,704 and £6,243 respectively.
