Supporting pregnant workers - a union reps guide (September 2016)

Chapter 2

Time limit

[ch 2: page 25]

The time limit for all discrimination claims is three months from the date of the discriminatory act. Unions and other campaigners have called for this time limit to be extended to six months for claims of pregnancy and maternity discrimination. The government has rejected this proposal.

There is more information about time limits and about the process of bringing a tribunal claim in LRD’s annual guide for trade union reps, Law at Work www.lrdpublications.org.uk/publications.php?pub=BK&iss=1827).

Reps and members must take great care with all time limits. The employment tribunal rarely extends time to bring a claim. Early legal advice must always be taken to make sure the tribunal deadline is not missed.
