Preparing statements

The claimant’s evidence, and that of any witnesses, should refer in their statements to any relevant documents in the bundle of documents (see page 31), with page numbers, so that the parties can easily find them during the hearing and the tribunal can readily revisit them when reaching its decision. Witness statements should:

• include the name of the tribunal and the claim number;

• be typed;

• state that it is the claimant’s evidence, or the witness statement of (the individual’s name) ;

• include the name, address and job title if relevant;

• if it is the claimant’s evidence, include a summary of their employment history;

• contain all the evidence the witness is going to give — further questions cannot usually be asked of your own witnesses, making this the opportunity to include facts in response to points the employer is likely to make (which may be gleaned from their Response Form ET3);

• contain a statement of truth confirming it is true to the best of the person’s knowledge and belief; and

• be signed and dated.
