Contracts of employment - a guide to using the law for union reps (September 2013)

Chapter 10

Enforcing the National Minimum Wage

Workers who are not being paid the National Minimum Wage should contact the Pay and Work Rights Helpline on 0800 917 2368. The helpline is able to refer relevant complaints from workers about non-payment of the minimum wage to Her Majesty’s Revenue and Customs (HMRC), to be enforced by National Minimum Wage compliance officers. Any arrears that are recovered are then paid to workers. Alternatively, a worker can bring a claim direct in the Employment Tribunal.

Advice can also be found on the web page of the Gangmasters Licensing Authority http://gla.defra.gov.uk/Guidance/ac/en/Advice-For-Workers

The GLA provides instructions on confidential reporting of exploitative employers in the sectors where it operates, but it does not enforce claims for the National Minimum Wage.
