However wide and unfair an express variation term may be, there is no scope for any argument based on the Unfair Contract Terms Act 1977. In Commerzbank AG v Keen [2007] IRLR 132, the Court of Appeal confirmed that employees are not “consumers”, and so are not covered by the Act.
