Temporary agency workers

Temporary agency workers are “workers”, so they qualify for the rights listed on page 73. In addition, qualifying temporary agency workers have extra rights under the Agency Workers Regulations 2010. These rights are based on the principle of equal treatment with equivalent members of the hirer’s directly employed workforce and are summarised in Chapter 7.

Temporary agency workers are not employees. They cannot claim unfair dismissal, redundancy, parental leave rights, or any of the other rights available only to employees (see page 74).
