2. WHEN DOES TUPE APPLY?

TUPE rights do not apply to every change of employer. Broadly speaking, the greater the similarity of the activities carried out before and after the transfer, the more likely TUPE is to apply. The Collective Redundancies and Transfer of Undertakings (Protection of Employment)(Amendment) Regulations 2014 (the 2014 Regulations) have made some changes to the rules as to when TUPE applies. These changes are highlighted in this Chapter.
