Legal sources and publications
Throughout this booklet, references are made to the relevant statutes (legislation). Copies of these can be obtained directly from The Stationery Office, tel: 0870 600 5522 or visit: www.tso.co.uk. Employment legislation is available free online from: www.legislation.gov.uk/ukpga/1996/18/contents. Remember that some legislation may have been amended so you will need to check for updates.
Most recent Employment Appeal Tribunal cases can be freely downloaded at: www.employmentappeals.gov.uk/public/search.aspx or at: www.bailii.org/uk/cases/UKEAT. Alternatively, the quickest way to find an Employment Appeal Tribunal judgement is often simply to type the names of the parties into a search engine such as Google.
Employment tribunal decisions (i.e. decisions that are not appealed to the Employment Appeal Tribunal) are rarely published because unlike decisions of the Employment Appeal Tribunal, they do not bind later tribunals to follow their decisions.
Some of the decisions referred to in this booklet have been taken by the European Court of Justice (ECJ). Copies of these decisions are freely available to download at http://curia.europa.eu/jurisp.
The Labour Research Department (LRD) publishes booklets on specific legal issues. Some of these are referred to in the main text of this booklet; others include Contracts of employment — a legal guide (£4.70), which deals in more detail with the specific contractual issues mentioned in this booklet. In addition, the annual Law at work gives a full overview of employment law.
LRD’s publication Law at work is updated annually priced £23.25 and provides clear practical guidance on employment law to trade union reps and members.
Reps handling redundancies and restructuring may also find our recent publication useful: TUPE — a guide for trade union reps, 2011: price £6.65.
Our monthly magazine Workplace Report contains quarterly updates on case law relating to contracts, termination of employment, discrimination, TUPE and tribunal procedures.
